We built it to help you understand what's happening in your own app. We don't know every one of our customers personally, so we've put in place these Terms of Service to keep things running smoothly for everyone. ## The short version - You can use ReplayPilot to record and review sessions on your own site or app. - You're responsible for telling your own users you use a tool like this, if your local law requires it. - Don't use ReplayPilot to record data you're not allowed to collect. - We bill paid plans monthly. You can change or cancel your plan any time. - We can suspend an account that abuses the service or breaks these terms. ## Agreeing to these terms When you use ReplayPilot, now or in the future, you're agreeing to the latest version of these Terms. If you're signing up on behalf of a company, you're confirming you have the authority to bind that company to them. There may be times we don't enforce a right or provision here, but that doesn't mean we're waiving it. ## Account terms - You're responsible for maintaining the security of your account and password, and for ensuring that any of your teammates do the same. We can't and won't be liable for loss or damage from your failure to comply with this. We recommend turning on two-factor authentication for extra security. - Don't use ReplayPilot to record data you don't have the right to collect, and don't permit anyone else on your account to do so either. - You're responsible for all content and activity that occurs under your account, including anything done by teammates you've invited. - You must be a human. Accounts registered by bots or other automated methods aren't permitted. ## Payment, refunds, and plan changes - If you're on ReplayPilot's free plan, it's free. We don't ask for a credit card, and just like paying customers, we don't sell your data. - Prices and session limits for paid plans are listed on [our pricing page](/pricing), which is part of these terms. You need to pay to keep using a paid plan; if payment fails, we'll let you know before we downgrade or freeze the account. - Paddle's customer portal handles upgrades and downgrades. You see exactly how a change affects your next invoice before you confirm it. - Paddle, our merchant of record, is responsible for determining, collecting, and remitting any taxes, levies, or duties owed on your subscription. - We don't offer refunds for partial months, except where required by law. Details in our [Refund Policy](/policies/refunds). ## Cancellation and termination You're solely responsible for canceling your account. Delete it any time from Settings, in the Danger zone. Type your account email to confirm, and we delete everything. No email or phone call needed. Deletion is immediate and permanent, not scheduled or handled by hand. The moment you confirm, we purge your sessions, projects, and account record. Export anything you need first: once it's deleted, we can't get it back. We can suspend or close an account that abuses the service, doesn't pay, or breaks these terms, and we'll tell you why. ## Changes to the service and prices We may modify or discontinue part of ReplayPilot at any time, with or without notice. We'll try to give you a heads-up for anything that affects how you use it. If we change the pricing structure, we typically exempt existing customers. If we do change your price, we'll give at least 30 days' notice by email before it takes effect. ## Data retention How long we keep your data, and each plan's log volume, are listed on [our pricing page](/pricing). Dashboard retrieval follows the same window as storage retention: 30 days on Free, 90 days on Starter and Growth, 180 days on Scale, and unlimited on Enterprise. Each plan also has a log volume allowance. Once an account hits it, we keep recording sessions as normal but stop writing new log lines until older ones age out of the retention window. ## Uptime, security, and privacy Your use of ReplayPilot is at your own risk. We provide it on an "as is" and "as available" basis, and we don't currently offer a formal uptime SLA. We encrypt data in transit and mask passwords and card numbers before we ever store a session. Add your own masking selectors for anything else sensitive to your product. When you use ReplayPilot, you're trusting us with your data, and we take that trust seriously. No one at ReplayPilot looks at your content except for limited reasons, with your permission. That's things like a support request, or the rare case where an automated process errors out and needs a human to fix it. We aim to fix the root cause so those errors don't recur. We rely on a small set of infrastructure providers to run the service: Cloudflare for hosting, storage, and AI features, and Paddle for billing, as merchant of record. They act as our processors, on our instructions, and not as independent users of your data. As a company, our policy is to not respond to government requests for data unless compelled by legal process, or in limited emergency circumstances. Where we're required to disclose data, we'll notify affected account holders first, unless we're legally prohibited from doing so. Under the California Consumer Privacy Act, ReplayPilot is a "service provider," not a "business" or "third party," with respect to your use of the service: we only process data you share with us for the purpose you signed up for, and we don't sell it. If GDPR or UK GDPR applies to your use of the service to process your users' data, see our [Data Processing Addendum](/policies/dpa). ## Your data, our software You give us a limited license to use the content you upload to provide the service to you, but we claim no ownership over it. The sessions you record, and anything else you submit, remain yours. ReplayPilot's software, design, and branding belong to us. Your subscription gives you the right to use the service, but it doesn't transfer any of that to you. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without our written permission. ## API and MCP access We offer an MCP (Model Context Protocol) server so you and your AI tools can query your ReplayPilot data programmatically. Authenticate it with your account master key or a project's secret key. Keep those keys secret. Anyone who has one can access data through the API the same way you can from the dashboard. We may temporarily suspend access that's abusive or excessively frequent. We'll try to warn you first unless your usage is causing problems for other customers. ## Features and bugs We design ReplayPilot with care, based on our own experience and the feedback customers share with us. There's no such thing as software that pleases everybody, though, and we don't guarantee it will meet your specific requirements or expectations. As with any software, ReplayPilot inevitably has some bugs. We track what's reported to us and prioritize anything related to security or privacy, but we don't guarantee completely error-free software. ## Limitation of liability To the extent the law allows, neither of us is liable to the other for indirect, incidental, or consequential damages, such as lost profits or lost data. Our total liability to you for any claim arising from these terms or the service caps at the amount you paid us in the 12 months before the claim arose. In other words: choosing to use ReplayPilot means you're making a bet on us. If the bet doesn't work out, that's on you, not us. We do our best to be a safe bet, through careful engineering, security investment, and just generally giving a damn. If you choose to use ReplayPilot, thank you for betting on us. ## Indemnification You agree to cover our reasonable costs if a third party brings a claim against us over your use of the service. That covers any use that violates these terms or applicable law, including a claim that you recorded session data you weren't allowed to collect. ## Governing law and disputes Most disagreements sort themselves out over email: write to [hello@replaypilot.com](mailto:hello@replaypilot.com) before filing anything. ## General If any part of these terms turns out to be unenforceable, the rest still stands. These terms, together with the pricing page, are the whole agreement between us: nothing else we've said supersedes them. You can't assign these terms to someone else without our consent; we can, as part of a merger, acquisition, or sale of the business. Neither of us is responsible for a delay caused by something genuinely outside our control. ## Changes to these terms If we change these terms in a way that matters, we'll update the date at the top and email account holders.
